A MAN refused to take a drugs test because the last one he had left him with raging toothache.

Martin Harris, 50, of Westmorland Avenue, Blackpool, pleaded guilty to failing to provide a saliva sample to test for Class A drugs in his body and also admitted theft.

He was given a 12 months conditional discharge and ordered to pay £17 compensation by Blackpool magistrates.

Martine Connah, prosecuting, said on June 8 CCTV footage showed Harris twice going into the Co-Op in Red Bank Road, and stealing a total of 12 cans of lager.

When he was arrested for theft he was required to provide a sample to test for Class A drugs, but he refused.

Kathryn Edwards, defending, said a previous drugs test on Harris had involved putting a small stick in his mouth to obtain a sample.

The stick had then hit a decaying tooth and he suffered toothache for weeks after the sample was taken and has now refused ever to take another drugs test.
