Both parties who lost legal challenges over fracking last month are to appeal.
Gayzer Frackman, of Lytham, and the Preston New Road Action Group are going to the Court of Appeal to fight the decision by communities secretary, Sajid Javid to overturn Lancashire County Council’s refusal of planning permission for fracking near Little Plumpton.
Having taken advice from our legal team we are currently seeking permission through the courts to appeal
Marc Willers QC, of Garden Court Chambers, representing Mr Frackman, said they were going to the Court of Appeal on the basis the Government did not assess the impact of greenhouse gas emissions, before it approved fracking and because adequate regulation was not in place.
A statement from the Preston New Road Action Group said: “Having taken advice from our legal team we are currently seeking permission through the courts to appeal.”
