‘Momentary lapse’ led to death

A PENSIONER died after she was knocked over and killed in a horror crash.

Blackpool magistrates were told how an 84-year-old driver suffered a momentary lapse of concentration before knocking over the 87-year-old woman pedestrian.

Carlton Terry, of Ferrier Bank, Warton, pleaded guilty to causing the death of Gwennie Dean by driving carelessly.

He was sentenced to a three months curfew between 8pm and 6am, banned from driving for 12 months and must take an extended test if he wanted to drive again when he appeared before Blackpool Magistrates’ Court.

District Judge Jeff Brailsford told Terry: “Life is without price and you cannot put a value on it. Nothing you can do or say will turn back the clock. I have to bear in mind the momentary lapse of concentration caused an accident in which a lady died.”

Nigel Beeson, prosecuting, said the incident took place on August 8 last year about 2pm as Terry drove his Nissan Micra along Poulton Street in Kirkham town centre.

The prosecutor said Gwennie Dean was crossing the road from right to left when Terry collided with her.

A police accident report stated Terry was not speeding and the car had no mechanical defects. Calculations showed Terry had had enough time to stop or slow to let the pedestrian cross.

Steven Townley, defending, said his client, a widower, had no previous convictions. He had no major medical difficulties, had previous worked in the building and removal trade and had extensive driving experience. He had been driving for more than 50 years with only a couple of speeding endorsements.

Terry had shown genuine remorse, suffered depression and lost weight. He had voluntarily surrendered his licence to DVLA soon after the incident.

Mr Townley added: “He did not see the lady as she crossed the road. It was a momentary lapse of concentration, which he cannot explain.”
