Birthday night ends in attack
A BIRTHDAY night out ended on a sour note when a man was attacked by someone he believed was "scrounging" off his friends.
Andrew Lillystone punched Stuart Burns while holding him in a headlock.
He then dragged the victim to the floor and continued to strike him to the head five or six times after the fall out on February 28 last year.
The defendant, 25, then kicked him two or three times around the head and stomach area as he lay on the floor, Preston Crown Court was told.
Lillystone, of Westlands Court, Thornton, had earlier admitted actual bodily harm assault.
Katherine Pierpoint, prosecuting, said Mr Burns had been out drinking with friends when he ran into the defendant who joined the group.
He appeared to have no money and seemed to be scrounging cigarettes and drinks.
At the end of the night, the group was at the C Cabs taxi office on Caunce Street. Lillystone was scrounging for a cigarette but Mr Burns told him to go away.
The defendant told him: "You can't speak to me like that" and launched an attack, said Miss Pierpoint.
Virginia Hayton, defending, said her client was due to become a father in the spring and had finally grown up.
He was given 10 months jail, suspended for two years, with 120 hours unpaid work and must pay 500 compensation and 300 towards costs.
