A HOSPITAL worker who told a colleague she should take a rape alarm when getting a lift from one of the male porters has been told he is free to continue working alongside the man.
Radiographer Shawn Anderson was repeatedly aggressive, abusive and rude towards colleagues at Blackpool Victoria Hospital, the Health Professions Council heard.
The tribunal was told he ripped a necklace from a male student’s neck and said “We should bin the complaint sheet” during a staff training session.
A female colleague told the panel: “He said I had a moustache and intimated I was overweight.”
The medic also repeatedly abused one porter, culminating in an incident where he told a colleague: “If you are going in a car with him, you had better take a rape alarm.”
He was initially dismissed by a disciplinary panel, but was allowed to return to work on appeal.
Panel chairman John Williams said: “Mr Anderson’s misconduct was serious and it is not satisfied he has full insight into his behaviour or its impact on others.
‘He has shown little empathy for the victims of his rude and aggressive behaviour and no real remorse.”
But the panel noted the radiographer had successfully returned to work under a set of conditions designed to improve his behaviour, and there had been no further complaints since.
He concluded the finding of impairment against Mr Anderson was enough to maintain standards and it was not necessary to find he was currently impaired in his work, given the improvements in his behaviour.
The panel ruled his behaviour on occasion was “inappropriate, abusive, rude and aggressive” but said it was not satisfied his comment about raping a colleague “amounted to aggressive behaviour”.
The panel found Anderson guilty of misconduct by ripping a necklace from a male student’s neck.
His comments to a female colleague about being fat and having a moustache were also “rude and inappropriate”.
The panel ruled that while Anderson was guilty of misconduct, he was not currently impaired and no sanction was necessary.
